The following terms apply to all websites, domains, services, applications, and products, test, and test results ("Websites") owned and/or operated and/or distributed by and/or tested by Pharma GenLabs LLC and its subsidiaries, collectively ("Pharma Genlabs", “we” or “us”).

Legal Notice

The materials on all Pharma Genlabs Websites are provided by Pharma Genlabs as a service to its customers and the general public and shall be used for informational purposes only. BY ACCESSING THESE SITES AND/OR ORDERING ANY TEST(S) FROM THIS SITE, YOU AGREE TO THESE TERMS. IF YOU DO NOT AGREE TO THESE TERMS, THEN DO NOT USE THIS SITE OR ORDER ANY TEST(S) FROM THESE SITES.

SAFETY WARNINGS & HEALTH WARNINGS & RISKS

· Do NOT use your test results to start, stop, or change any course of treatment. Medications should always be taken as directed. Making changes on your own can lead to harmful side effects and/or reduce the intended benefits of the medication.

· Results from this test should NOT ever be used to make medical decisions.

· Results from this rest are NOT intended to diagnose, treat, prescribe any medications, or to suggest any changes to any course of medical treatment.

· Any and all changes to any and all course(s) of medical treatment should only and always be under the direction and supervision of your licensed healthcare professionals.

LIMITATIONS OF THIS TEST

· Test results are only intended to provide you with information that can inform conversations with a licensed healthcare professional regarding potential genetic insights. 

· Test results do NOT replace discussions with a healthcare professional about the best course of treatment for you and cannot determine whether a medication is indicated for you.

· Test results do NOT determine how you would respond to a particular medication. 

· Test results do NOT diagnose any health conditions or tell you anything about your risk of developing any disease or condition.

· Test results can NOT account for many variables and factors such as medical history, allergies, mental health status, or drug interactions - all of which are necessary for a licensed healthcare professional to take into account for before prescribing any course of treatment. Potential genetic insights alone should NOT ever be the sole rationale for any licensed healthcare professional to prescribe any medication or medical course of treatment.

· Test results do NOT replace the need for ongoing healthcare consultations.

· Test results should ALWAYS be confirmed by an independent genetic test prescribed by your own licensed healthcare professional.

FDA DISCLOSURE

This test has not been cleared or approved by the Food and Drug Administration (FDA) for use in medication prescribing decisions.

BENZODIAZEPINE WARNINGS & RISKS
· Benzodiazepines (e.g., alprazolam, lorazepam) are controlled substances with a high potential for misuse, dependence, and addiction.
· These medications have serious side effects and may lead to risks such as, overdose, dependency, sedation, and drug interactions. These risks require close medical supervision when prescribed or adjusted.
· Genetic testing alone is insufficient to safely prescribe or alter the use of these medications. Please seek medical advice from your licensed healthcare provider regarding the use and adjustment of any benzodiazepine medications.
ADHD MEDICATION WARNINGS & RISKS
· ADHD medications (e.g., Adderall, Vyvance, and Ritalin) are controlled substances with a high potential for misuse, dependence, and addiction.
· These medications have serious side effects and may lead to risks such as overdose, dependency, and drug interactions. These risks require close medical supervision when prescribed or adjusted.
· Genetic testing alone is insufficient to safely prescribe or alter the use of these medications. Please seek medical advice from your licensed healthcare provider regarding the use and adjustment of any ADHD medications.
ANTIDEPRESSANT WARNINGS & RISKS
· Antidepressant medications (e.g., Prozac, Zoloft, Effexor, and Paxil) have a potential for misuse, dependence, and addiction.

· These medications have serious side effects and may lead to risks such as overdose, dependency, and drug interactions. These risks require close medical supervision when prescribed or adjusted.
· Genetic testing alone is insufficient to safely prescribe or alter the use of these medications. Please seek medical advice from your licensed healthcare provider regarding the use and adjustment of antidepressant medications.
MOOD STABILIZER WARNINGS & RISKS
· Mood stabilizer medications (e.g., Prozac, Zoloft, Effexor, and Paxil) have a potential for misuse, dependence, and addiction.
· These medications have serious side effects and may lead to risks such as overdose, dependency, and drug interactions. These risks require close medical supervision when prescribed or adjusted.
· Genetic testing alone is insufficient to safely prescribe or alter the use of these medications. Please seek medical advice from your licensed healthcare provider regarding the use and adjustment of mood stabilizer medications.

ANTIPSYCHOTIC WARNINGS & RISKS

 · Antipsychotic medications (e.g., Abilify, Haldol, and Risperdal) have a potential for misuse, dependence, and addiction.
· These medications have serious side effects and may lead to risks such as overdose, dependency, and drug interactions. These risks require close medical supervision when prescribed or adjusted.
· Genetic testing alone is insufficient to safely prescribe or alter the use of these medications. Please seek medical advice from your licensed healthcare provider regarding the use and adjustment of antipsychotic medications.

MEDICAL EMERGENCY

If you think you may be having a medical emergency, please immediately call 911 to get prompt medical attention.

AT YOUR OWN RISK

You are solely responsible for any decisions you make or actions that you take based on any test results you receive from Pharma GenbLabs LLC and/or any materials available or transmitted through any Pharma GenLabs LLC's websites or applications and/or any of Pharma GenLabs services. 

Use of Personally Identifiable Information Pharma Genlabs

Information submitted to Pharma Genlabs through our Websites is governed according to the Pharma Genlabs’ Websites Privacy Policy.

No Unlawful or Prohibited Use

As a condition of your use of the Pharma Genlabs Websites, you agree to not use the Websites for any purpose that is unlawful or prohibited by these Terms of Use. You may not use the Websites in any manner which could damage, disable, overburden or impair the Websites or interfere with any other party's use and enjoyment of the Websites. Indemnification

Governing Law, Submission to Jurisdiction and Venue

These Terms of Use shall be governed by and construed in accordance with the laws of the State of Ohio without regard to its choice of law provisions, and the federal laws of the United States. Any action or proceeding arising under or relating to this Agreement shall be brought only in the courts of the State of Ohio, or, if it has or can acquire jurisdiction, in the United States District Court for District of Ohio. You consent to the exclusive jurisdiction of such courts (and the appropriate appellate courts) in any such action or proceeding and waive any objection to venue. Process in any action or proceeding referred to in the preceding sentence may be served on you anywhere in the world. At Pharma Genlabs’ sole discretion, it may require you to submit any disputes arising from the use of these Terms of Use or the Websites, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying Utah law.

ANY CAUSE OF ACTION OR CLAIM YOU MAY HAVE ARISING OUT OF OR RELATING TO THESE TERMS OF USE OR THE WEBSITES MUST BE COMMENCED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OTHERWISE, SUCH CAUSE OF ACTION OR CLAIM IS PERMANENTLY BARRED.
